Booking Terms and Conditions

These terms apply to all bookings made with Rake Healing Limited (the Artist), operated by Kenrick Smith. By paying a deposit, the Client confirms they have read and agreed to these terms.

  1. The Artist

Rake Healing Limited is operated by Kenrick Smith and provides land art commissions, workshops, and related creative services.

  1. Services

Services to be provided are described in the invoice issued for each booking. The Artist reserves the right to make reasonable creative decisions regarding execution of the work, including choice of tools, technique, and timing, within the scope agreed.

  1. Pricing and Payment

All prices are in New Zealand dollars and exclude GST. GST will be added to all invoices. A deposit is required to confirm the booking (see Deposit Terms below). The balance is due 14 days before the event date, unless otherwise agreed in writing.

  1. Deposit Terms

A deposit of 25% of the commission fee is required to secure the booking date. No date is held until the deposit is received. The deposit is non-refundable.

Where the commission requires pre-booked flights, travel, or accommodation, full payment of those costs is required at the time the deposit is paid. These costs are non-refundable once booked.

  1. Cancellation Policy

If the Client cancels the booking, the deposit is forfeited. No further payment is required.

Where possible, the Artist will offer one opportunity to reschedule within 12 months of the original booking date. If a new date is agreed in writing, the deposit transfers to that booking. If no new date is agreed within 12 months, the deposit is forfeit and the booking ends with nothing further owed by either party.

Pre-booked flights, travel, or accommodation costs are non-refundable once booked, regardless of when cancellation occurs.

All cancellations must be submitted in writing to hello@rakehealing.com.

  1. Natural Conditions

Land art is created in outdoor environments and is inherently dependent on natural conditions. The Artist will assess factors including weather, wind, rain, tides, beach conditions, slope, sediment quality, wildlife, and other site conditions, and makes the final call on whether the work can proceed as planned.

If the Artist determines that conditions make it unsafe or impractical to proceed, the Client will be offered: (a) a rescheduled session at a mutually agreed date, or (b) a full refund of all payments made, excluding non-refundable travel and accommodation already incurred. The Artist will provide as much notice as possible, and at least 48 hours where conditions allow.

If the Artist confirms the session is going ahead and the Client chooses not to proceed, the standard cancellation terms above apply.

  1. Client Responsibilities

Clients must confirm final participant numbers no later than 7 days before the event, ensure all participants are informed the session takes place outdoors, ensure participants wear suitable footwear and clothing for outdoor and beach conditions, and flag any participants with mobility limitations in advance so appropriate arrangements can be made.

  1. Photography and Content

All photo and video content created by the Artist during the commission is owned by the Artist. Client licence and usage rights for any photos or video must be agreed in writing before the event. If no written agreement is in place, the Client has no right to use the content commercially or publicly.

The Artist retains the right to use all content for portfolio, marketing, and promotional purposes, including on social media and rakehealing.com, unless otherwise agreed in writing before the event.

  1. Liability

Participants engage in the activity at their own risk. The Artist takes all reasonable precautions for participant safety.

The Client agrees to inform participants that the activity takes place in outdoor conditions. The Artist is not liable for loss, injury, or damage arising from circumstances beyond their reasonable control, including weather, site conditions, third-party interference, or participant behaviour.
